Dwayne Giles shot and killed Brenda Avie, his ex-girlfriend, and claimed self-defense. At trial, to rebut Giles's testimony that she was the aggressor, prosecutors introduced statements that Avie had made three weeks before the shooting to a police officer responding to a report of domestic violence. Crying while she spoke, Avie told the officer that Giles had choked, punched, and threatened to kill her. After he was convicted of murder, Giles claimed that the admission of Avie's hearsay statement was a (...) violation of the Confrontation Clause. The state responded that the defendant had forfeited his right to confront Avie by killing her. In the last week of its last Term, the United States Supreme Court considered these arguments in California v. Giles. The case was decided in the wake of Crawford v. Washington and Davis v. Washington, which together transformed the Confrontation Clause and, as a consequence, the prosecution of domestic violence. Giles, which generated five opinions and exposed a Court deeply ambivalent about the reinterpreted confrontation right, has done little to impose order on this chaos. This Essay, which will be published in Lewis and Clark's symposium issue on Giles, contemplates the future of domestic violence prosecution in a period of uncertainty. My analysis endeavors to guide lower courts in the task of application and to map a course for the evolution of prosecutorial approaches to battering. I conclude that Giles represents a significant opportunity for those concerned about the constraints Crawford and Davis had seemed to place on the prosecution of domestic violence. For the first time, the Court has identified "the domestic violence context" as a relevant construct, thereby compelling lower courts to grapple with the particularities of violence between intimates. This is a remarkable shift in relatively short order, and it allows us to glimpse the possibility of a jurisprudence informed by the realities of battering. (shrink)

Background:Ethical issues are increasingly being reported by care-providers; however, little is known about the nature of these issues within the nursing home. Ethical issues are unavoidable in healthcare and can result in opportunities for improving work and care conditions; however, they are also associated with detrimental outcomes including staff burnout and moral distress.Objectives:The purpose of this review was to identify prior research which focuses on ethical issues in the nursing home and to explore staffs’ experiences of ethical issues.Methods:Using a (...) systematic approach based on Aveyard (2014), a literature review was conducted which focused on ethical and moral issues, nurses and nursing assistants, and the nursing home.Findings:The most salient themes identified in the review included clashing ethical principles, issues related to communication, lack of resources and quality of care provision. The review also identified solutions for overcoming the ethical issues that were identified and revealed the definitional challenges that permeate this area of work.Conclusions:The review highlighted a need for improved ethics education for care-providers. This is a book with a mission: to keep the secularizing readers of Descartes's philosophy from the Church door. It stands as an important reminder that in understanding Descartes we cannot ignore his theology and achieves this goal in a lucid and erudite fashion. But the central tenet of the book—that Descartes subordinated much of his thinking about morals to the authority of religion—is, in my view, fundamentally mistaken. The basic approach to understanding shared agency has been to identify individual intentional states that are somehow “shared” by participants and that contribute to guiding and informing the actions of individual participants. But, as Michael Bratman suggests, there is a problem of stability and depth that any theory of shared agency needs to solve. Given that participants in a joint action might form shared intentions for different reasons, what binds them to one another such that they have some reason for (...) continuing to participate in the joint action in the face of conflicting reasons? This is particularly pressing in cases of joint actions that unfold over long periods of time. There are a variety of ways that the problem of stability and depth of shared intention might be addressed. We review some of those ways in section 1. We do not intend to challenge these approaches. Instead, in this article, we want to suggest that narrative is an additional, perhaps in some cases a predominant, way in which stability and depth are achieved. According to some theories, narrative plays a crucial role in the development of the self. Our suggestion is that the narratives we tell about our joint projects contribute to the development of a stable and deep “we.”. (shrink)

Paper, $19.95.Wayne Klein states in his Introduction to Nietzsche and the Promise of Philosophy that “Nietzsche’s texts are anomalous…because they explicitly and inexorably force us to question our assumptions about meaning, understanding and writing in a way that (...) few other philosophical texts have” (5). From its beginning, Klein’s book challenges the reader to think beyond the dualism of the literal and figurative meaning of words. For Klein, this task is central to understanding both the content and style of Nietzsche’s writings; or rather, it is essential to the recognition that ‘content’ and ‘style’ cannot be thought separately, especially when reading a poet-philosopher such as Nietzsche who meditates extensively on the intrinsic connection of the two. In his following chapters, Klein provides the reader with an innovative way of reading Nietzsche’s corpus, a strategy of interpretation which is acutely aware that Nietzsche’s philosophy is inseparable from Nietzsche’s rhetoric (6).Chapter One questions both Heidegger’s and Kaufmann’s interpretations of Nietzsche, which, according to Klein, “share a common conviction that Nietzsche’s thought can only be understood properly if it is abstracted from its context and read against the backdrop of his philosophy as a whole” (42). Through a detailed reading of Nietzsche’s 1872–73 Course on Rhetoric and the 1873 “On Truth and Lies in an Extra-Moral Sense,” Klein presents a convincing case that Nietzsche’s analysis in his early writings of truth as metaphor, metonymy, and synecdoche does not “deny that words can be true, but that with respect to their multifarious origins they are not principally concerned with truth as correspondence or identity” (70). Instead—with Heidegger’s concept of aletheia as the horizon—Klein suggests that Nietzsche’s early writings “insist on a radical undecidability between literal and figurative discourse” which leads Nietzsche to embrace “a conception of shining truth,” i.e., the veiled “shining forth of appearance” (78, 83). This notion of truth as shine or shining forth allows Klein to link Nietzsche’s earliest writings to later works such as Beyond Good and Evil and Twilight of the Idols in their portrayals of truth. Further-more, once this connection is established, Klein can challenge Clark’s reading that Nietzsche’s mature view of truth implicitly acknowledges an empirical dualism of “the true” and “the false.”After establishing that the division between style and content is an ontological dichotomy which Nietzsche’s work rejects, Klein can utilize this fundamental ambiguity between Nietzsche the philosopher and Nietzsche the rhetorician to reconsider specific concepts put forward in Nietzsche’s other writings. Over the last decade or so, there has been a renewed interest in a view about properties known as quidditism. However, a review of the literature reveals that ‘quidditism’ is used to cover a range of distinct views. In this paper I explore the logical space of distinct types of quidditism. The first distinction noted is between quidditism as a thesis explicitly about property individuation and quidditism as a principle of unrestricted property recombination. The distinction recently drawn by Dustin (...) Locke between extravagant quidditism and austere quidditism is a distinction between quidditisms of the first type. It is then argued that austere quidditism may itself be further sub-divided into what I call ‘extremely austere quidditism’ and ‘moderately austere quidditism’. Moderately austere quidditism is argued to be preferable to extremely austere quidditism and further to be able to address many of the arguments leveled against quidditism in general. (shrink)

Economists and other social scientists in this century have often supported economic arguments by referring to positions taken by philosophers of science. This important new book looks at the reliability of this practice and, in the process, provides economists, social scientists, and historians with the necessary background to discuss methodological matters with authority. Redman first presents an accurate, critical, yet neutral survey of the modern philosophy of science from the Vienna Circle to the present, focusing particularly on logical positivism, sociological (...) explanations of science (Polanyi, Fleck, Kuhn), the Popper family, and the history of science. The advent of HIV focussed broad social attention on the group of people most affected by it in Australia, the so-called ‘gay community’. However, what a gay community actually was, and what kind of rights and duties were being attached to it remained unclear. However, it is obvious that such a community — or communities — did not fit the model proposed by communitarian writers like Michael Sandel and Charles Taylor, whereby subjects cannot stand outside their own constitutive attachments. I (...) also consider the common criticism of communitarianism, and see what kinds of collectives can in fact be considered ethical.The first part of this paper looks at the ethical issues surrounding community attachment of this kind in Australia in relation to the ethics of HIV/aids clinical research. In particular I examine the way in which certain forms of gay community attachment can be used to strengthen personal autonomy and check exploitation within the prevention and research process.The second part of this paper draws upon the issues just discussed. In particular I focus on the use of ‘community’ in the research process in developing countries, and suggest ways in which cultural considerations might strengthen autonomy. However, I go on to suggest that in many cases the idea of community has served the opposite purpose, and has in fact been used to oppress certain individuals and groups within the developing world, in the so-called interests of the greater good. In order to avoid this, I suggest a model of social and ethical research whereby all subjects and researchers in the clinical process might stand in greater relationships of equality with each other. We review Evolution and the Levels of Selection by Samir Okasha. This important book provides a cohesive philosophical framework for understanding levels-of-selections problems in biology. Concerning evolutionary transitions, Okasha proposes that three stages characterize the shift from a lower level of selection to a higher one. We discuss the application of Okasha’s three-stage concept to the evolutionary transition from unicellularity to multicellularity in the volvocine green algae. Okasha’s concepts are a provocative step towards a more general understanding of the (...) major evolutionary transitions; however, the application of certain ideas to the volvocine model system is not straightforward. Edinburgh: Edinburgh University Press, 2022. xvii + 254 pp. Cloth, $110.00Histories of Scottish philosophy typically focus on the school of "common sense" from the eighteenth century, beginning with Francis Hutcheson and ending with Dugald Stewart. As Gordon Graham notes in the preface to this volume, nineteenth-century Scottish philosophy is "an area of the (...) history of philosophy that has generally gone almost entirely unexplored." His collection of eleven standalone essays (only one of which has been previously published) argues that something recognizable as "Scottish philosophy" continued into the nineteenth century—although Graham thinks it ended, then, too—and suggests conceptions of Scottish philosophy that go beyond the old trope of "common sense."Unusually for a work in the history of philosophy, the first chapter is autobiographical. Graham recalls that as an undergraduate studying moral philosophy at St. Andrews in 1968, the only Scottish philosopher he was assigned to read was Hume, whose work was taught in the ahistorical manner that dominated philosophy at that time, and that upon his appointment to the Regius Chair of Moral Philosophy at Aberdeen in 1995 he found little appreciation for the university's most famous former professor, Thomas Reid. Thus began Graham's establishment of the Reid Project at the University of Aberdeen (later the Centre for the Study of Scottish Philosophy and now the Institute for the Study of Scottish Philosophy), the founding of the Journal of Scottish Philosophy, and his editorship of several book series on Scottish philosophy. The story of Graham's scholarship over the years is really the story of the recovery of the history of Scottish philosophy after its near-total neglect in the twentieth century.Graham seems wary of the contextualist turn that historians of philosophy have embraced since around the 1980s, which he likens to "antiquarianism," but at the same time he notes that our current philosophical interests are "not an infallible or even an especially reliable guide to what is intellectually significant" from the past. His solution is to look for intellectual "trajectories" in the history of philosophy—although not with the Whiggish view that these culminate in the present—and to locate particular figures within those trajectories. Cheating is deeply embedded in everyday life. The costs of the most common forms of cheating total close to a trillion dollars annually. Part of the problem is that many individuals fail to see such behavior as a serious problem. "Everyone does it" is a common rationalization, and one that comes uncomfortably close to the truth. That perception is also self-perpetuating. The more that individuals believe that cheating is widespread, the easier it becomes to justify. Yet what is most notable (...) about analysis of the problem is how little there is of it. Whether or not Americans are cheating more, they appear to be worrying about it less. In Cheating, eminent legal scholar Deborah L. Rhode offers the only recent comprehensive account of cheating in everyday life and the strategies necessary to address it. Because cheating is highly situational, Rhode drills down on its most common forms in sports, organizations, taxes, academia, copyright infringement, marriage, and insurance and mortgages. Cheating also reviews strategies necessary to address the pervasiveness and persistence of cheating in these contexts. We clearly need more cultural reinforcement of ethical conduct. Efforts need to begin early, with values education by parents, teachers, and other role models who can display and reinforce moral behaviors. Organizations need to create ethical cultures, in which informal norms, formal policies, and reward structures all promote integrity. People also need more moral triggers that remind them of their own values. Equally important are more effective enforcement structures, including additional resources and stiffer sanctions. Finally, all of us need to take more responsibility for combatting cheating. We need not only to subject our own conduct to more demanding standards, but also to assume a greater obligation to prevent and report misconduct. Sustaining a culture that actively discourages cheating is a collective responsibility, and one in which we all have a substantial stake. (shrink)

Burnyeat's map is an ambitious attempt to establish two claims about Zeta: that Aristotle employs an unusual, non-linear form of argument in Zeta, and that the discussion in Zeta is on two levels, one abstract and "logical" and (...) another specific and "metaphysical." In addition to looking at Zeta, chapter by chapter, Burnyeat examines the other works that provide the context for Zeta—the Organon for the logical level of explanation and the rest of the Metaphysics for the metaphysical level. Burnyeat argues that Aristotle's metaphysical project culminates in the theology of'Lambda, for which the metaphysics of Zeta has prepared us. The goal is to "map" or sketch the evidence for these claims rather than provide definitive arguments for them.A brief introductory chapter presents the main themes of the book. This is followed by an even briefer chapter that sets out the four routes (or independent sections of Zeta), viz. Z 3; Z 4-6, 10-11 with Z 7-9, 12; Z 13-6; and Z 17 with H 1. On all four routes, a logical discussion moves to a metaphysical discussion of form and matter.The third chapter on "signposts" is the lengthiest of all and takes the reader through the chapters of Zeta in order. It is also the most map-like of the chapters, as it requires that the reader have a copy of the Metaphysics ready to hand. Burnyeat follows other commentators in treating Zeta 7-9 and Zeta 12 as later insertions; he does, however, argue that the former and probably the latter were added by Aristotle. Wrapping up the discussion of Zeta, Burnyeat concludes that the goal of Zeta's two-level approach has been to show how logical concepts should be used to search for form.This leads directly to a chapter on the Organon. Burnyeat argues that none of the treatises making up the Organon are metaphysical; all employ an abstract (logical) mode of analysis. Even if written at different times, these treatises belong together because they are all methodological. Since form and matter belong to the metaphysical level, in the Analytics Aristotle "follows a deliberate policy of excluding form and matter" (97).In the final chapter, Burnyeat returns to the Metaphysics and considers Zeta in the context of the other books. Thus, this book stands as a helpful counterbalance to a certain kind of scholarship on Zeta. The two interpretative claims, however, that are at the heart of Burnyeat's enterprise stand in need of further justification. One of these, the non-linearity of Zeta, seems to be too weak to support substantive claims. Burnyeat defines non-linearity as holding when "it is not the case that the successive chapters build continuously upon the results of their predecessors" (4). Pp. 391.Meeting of Minds: Intellectual and Religious Interaction in East Asian Traditions of Thought, a volume of eleven essays written in honor of Wing-tsit Chan and William Theodore (...) de Bary, proposes to explore how Confucian and Neo-Confucian traditions have responded to and have influenced other traditions (Buddhist, Taoist, folk, Japanese nativist, and so on) in China and Japan. The essays are arranged first geographically (seven articles on China precede four on Japan) and then roughly chronologically. All essays, save one, describe Sung or post-Sung developments. A few sentences per essay must suffice in this review.Irene Bloom's "Three Visions of Jen" is the only essay on the classical period. Informed especially by Wing-tsit Chan's work on jen and shaped by Sung and later notions of the transmission of the way, the essay examines the notion of jen in the Analects, the Mencius, and Chu Hsi's "Jen shuo" (Discussion of jen), succinctly [End Page 318] emphasizing the significant differences of perspective therein. Nodding to the book's larger intent of examining intellectual interactions with other traditions, some attention is given in the conclusion to comparisons with the Mohist, Yangist, and Ch'an traditions. Rodney Taylor's "Chu Hsi on Meditation" is also deeply indebted to Wing-tsit Chan and starts by resurveying much terrain already explored in Chan's 1989 "Chu Hsi and Quiet-Sitting" (in Chu Hsi: New Studies, published by University of Hawai'i Press). Taylor enlarges upon Chan's work especially in his discussion of Chu Hsi's practices of breath-control techniques to improve health. In keeping with the larger direction of the book, Taylor contrasts Chu's emphasis on quiet sitting as a support for study with the different spiritual goals of Ch'an Buddhism.Patricia Ebrey's "Sung Neo-Confucian Views on Geomancy" examines a topic that is seldom encountered in American scholarship: the attitudes of such figures as Ssu-ma Kuang, Ch'eng I, Chu Hsi, and Ts'ai Yan-ting toward popular practices governing the placement of graves. Ebrey outlines the views of those who, as it were, are "for" or "against" geomancy (Chu and Ts'ai took geomancy seriously, although Ssu-ma and Ch'eng viewed it with apprehension) but also provides textual evidence that allows one to see the grayer areas between support for, and condemnation of, feng shui and other arts. Julia Ching's "Chu Hsi and Taoism" considers Chu's interpretations of such classical texts as the I ching, Lao Tzu, Chuang Tzu, and Ch'u tzu and also assays his commentaries on such later texts as the Ts'an-t'ung-ch'i (an alchemical text Chu commented on with the assistance of Ts'ai Yan-ting) and the Yin-fu-ching (a commentary that Ching concludes is most likely not Chu's work). Paper, $19.95.Wayne Klein states in his Introduction to Nietzsche and the Promise of Philosophy that “Nietzsche’s texts are anomalous…because they explicitly and inexorably force us to question our assumptions about meaning, understanding and writing in a way that (...) few other philosophical texts have” (5). From its beginning, Klein’s book challenges the reader to think beyond the dualism of the literal and figurative meaning of words. For Klein, this task is central to understanding both the content and style of Nietzsche’s writings; or rather, it is essential to the recognition that ‘content’ and ‘style’ cannot be thought separately, especially when reading a poet-philosopher such as Nietzsche who meditates extensively on the intrinsic connection of the two. In his following chapters, Klein provides the reader with an innovative way of reading Nietzsche’s corpus, a strategy of interpretation which is acutely aware that Nietzsche’s philosophy is inseparable from Nietzsche’s rhetoric (6).Chapter One questions both Heidegger’s and Kaufmann’s interpretations of Nietzsche, which, according to Klein, “share a common conviction that Nietzsche’s thought can only be understood properly if it is abstracted from its context and read against the backdrop of his philosophy as a whole” (42). Klein also criticizes Nehamas’ reading of Nietzsche which endeavors to discover “thematic connections and continuities among Nietzsche’s writings, without attempting to take the texts on their own terms as texts” (50). Ultimately, Klein views all three readers as offering an interpretation of Nietzsche in which “the ‘what’ of Nietzsche’s writings is thoroughly divorced from the ‘how’ ” (42).Klein’s strongest evidence for his position of Nietzsche as philosopher-rhetorician is presented in Chapters Two and Three. In Chapter Two, Klein argues against the view [End Page 639] of Maudemarie Clark that (l) Nietzsche’s later writings affirm a “common-sense” or empirical view of truth, and therefore, (2) Nietzsche’s earlier rhetorical descriptions of truth ought to be rejected by the reader who desires to understand Nietzsche’s mature thought (58–59). Through a detailed reading of Nietzsche’s 1872–73 Course on Rhetoric and the 1873 “On Truth and Lies in an Extra-Moral Sense,” Klein presents a convincing case that Nietzsche’s analysis in his early writings of truth as metaphor, metonymy, and synecdoche does not “deny that words can be true, but that with respect to their multifarious origins they are not principally concerned with truth as correspondence or identity” (70). Instead—with Heidegger’s concept of aletheia as the horizon—Klein suggests that Nietzsche’s early writings “insist on a radical undecidability between literal and figurative discourse” which leads Nietzsche to embrace “a conception of shining truth,” i.e., the veiled “shining forth of appearance” (78, 83). This notion of truth as shine or shining forth allows Klein to link Nietzsche’s earliest writings to later works such as Beyond Good and Evil and Twilight of the Idols in their portrayals of truth. Further-more, once this connection is established, Klein can challenge Clark’s reading that Nietzsche’s mature view of truth implicitly acknowledges an empirical dualism of “the true” and “the false.”After establishing that the division between style and content is an ontological dichotomy which Nietzsche’s work rejects, Klein can utilize this fundamental ambiguity between Nietzsche the philosopher and Nietzsche the rhetorician to reconsider specific concepts put forward in Nietzsche’s other writings. Chapter Three interprets The Birth of Tragedy in this vein; however, the most provocative re-reading of Nietzsche occurs in Chapter Four, where Klein brings into question Nietzsche’s “naturalism,” his reliance in his later criticisms of metaphysics and morality upon a seemingly “essentialistic understanding” of central concepts such as the will to power, life, physiology, and sickness and health (141). The crisis of replication has led many to blame statistical significance tests for making it too easy to find impressive looking effects that do not replicate. However, the very fact it becomes difficult to replicate effects when features of the tests are tied down actually serves to vindicate statistical significance tests. While statistical significance tests, used correctly, serve to bound the probabilities of erroneous interpretations of data, this error control is nullified by data-dredging, multiple testing, and other biasing selection effects. (...) Arguments claiming to vitiate statistical significance tests attack straw person variants of tests that commit well-known fallacies and misinterpretations. There is a tension between popular calls for preregistration – arguably, one of the most promising ways to boost replication – and accounts that downplay error probabilities: Bayes Factors, Bayesian posteriors, likelihood ratios. By underscoring the importance of error control for well testedness, the replication crisis points to reformulating tests so as to avoid fallacies and report the extent of discrepancies that are and are not indicated with severity. This article examines a series of Greek myths which establish a structural equivalence between two motifs, stoning and blinding; the two penalties either substitute for one another in alternative versions of a single story, or appear in sequence as repayments in kind. After reviewing other theories concerning the motives behind blinding and lapidation, I argue that both punishments-together with petrifaction and live imprisonment, which frequently figure alongside the other motifs-are directed against individuals whose crimes generate pollution. This miasma affects not (...) only the perpetrator of the deed, but risks spreading to the community at large, and prompts measures aimed at containing the source of the disease. Both blinding and lapidation are designed to cordon off the contaminant by removing him from all visual and tactile contact with other men. But it is not only the nature of the crimes that explains the kinship between the two penalties. I further argue that the attributes Greek thinking assigned to stones, repeatedly characterized as unseeing, mute, immobile, and dry, and symbolic of the condition of the dead, elucidate the connections and clarify the antagonism that myth suggests between lapidation and sight. Stoning, blinding, imprisonment, and petrifaction all consign the criminal to an existence exactly parallel to that of the stone, stripping him of the properties that distinguish the living from the dead, and making him both unseeing and unseen. Three examples drawn from archaic and classical literature provide examples of these interactions between stones, blindness, invisibility, and death: the snake portent sent by Zeus in Book 2 of the Iliad, the Perseus myth, and Hermes' activity in both the Homeric Hymn to Hermes and Aeschylus' Choephoroe. For the last two decades, the world has seen the rise of China. With its rise, unfortunately, has come the fall, retreat, and demise of some animals and animal species. China is often singled out for special attention in terms of animal destruction and endangerment. With an increasingly globalized economy and world, we now have a globalized wildlife crisis. This essay focuses on the exploitation of wild animals in China. It argues that the plight of wildlife in China stems from (...) an underlying position in Chinese culture that animals are instruments for human benefits, and such an instrumentalist approach has always dominated the Chinese landscape. This is the case despite the fact that animals and humans are considered to be organically connected in the moral universe in Chinese traditional philosophy in contrast to the segregated approach to humans and non-humans in Western philosophical traditions. It is suggested that to achieve substantive progress in the protection of wildlife and other animals in China, a fundamental change of thinking and acting toward animals by the Chinese to recognize the intrinsic value of animals would be imperative. How and why, historian of science Lily Kay asks, did the ‘biological problem of DNA-based protein synthesis’ come to be represented ‘as an information code and a writing technology?’ What sort of metaphor was ‘code’ for these bio-geneticists? One whose run-away expansion, Derrida noted in Of Grammatology (1967), urgently required philosophical justification. Yet, 60 years later, there is still fundamental disagreement about its meaning and epistemic status. If the metaphor lacks ontological purchase, what accounts for its effectiveness? If, on the (...) other hand, scriptural metaphors get at the common root of culture and biology, what do we now mean by ‘code’? In this article, I trace several influential accounts of the metaphor’s effectiveness—making explicit the opposing notions of ‘code’ that animate them—and argue that each is too limited. Greater attention to the metaphoricity of ‘code’ yields a more philosophically productive and critical account of the metaphor of code. (shrink)

The health care industry has moved at a rapid pace away from paper records to an electronic platform across almost all sectors — much of it at the encouragement and insistence of the federal government. Such rapid expansion has increased exponentially the risk to individuals in the privacy of their data and, increasingly, to their physical well-being when medical records are inaccessible through ransomware attacks. Recognizing the unique and critical nature of medical records, the United States Congress established the Health (...) Care Industry Cybersecurity Task Force under the Cybersecurity Information Sharing Act of 2015 for the purpose of reviewing cybersecurity risks within the health care industry and identifying who will lead and coordinate efforts to address such risks among the various agencies. The Task Force has since issued a report setting forth six high-level imperatives that the health care industry needs to achieve in order to combat cybersecurity, and, notably, many of the vulnerabilities plaguing the industry identified in the Report as requiring correction are not necessarily related to specific flaws in the current cybersecurity framework, but rather susceptibilities presented by the infrastructure and associated regulatory regime that has evolved over the last few decades over the health care industry generally. That is, the current health care infrastructure by its nature exacerbates cybersecurity risk. Between a lack of information sharing of industry threats, risks, and mitigations, disparate leadership and governance goals for cybersecurity, the confluence and contradiction of existing federal and state laws, fragmentation in the fee-for-service delivery system, lack of care coordination, and disparate resources across and among sectors, the industry suffers from heightened cyber risk. Solutions that are reactive to problems within the current infrastructure will likely have little long term impact toward reducing cybersecurity vulnerabilities because they do not address the underlying system challenges. All of these confluences causes one to wonder whether if in fact the current health care delivery infrastructure is a contributing factor to the incidents of cybersecurity attacks and the exorbitant costs associated with resolving data breaches, should Congress look not just to curb breach incidents, but to address root cause systematic challenges in the health industry infrastructure that create increased exposure of cybersecurity threats? This article argues that cybersecurity risks will continue to be heightened and more costly to the health care industry as compared to other industries unless and until some general system redesign is achieved that allows for greater sharing of resources among industry participants to ensure the same protections are implemented at all levels of the industry, which can be strengthened through greater interoperability of systems across the health care industry; and increased focus and attention on the importance of cybersecurity issues as a priority among system reforms. This is not always a fashionable position, and in some company I know just what to expect: a pop deconstructivist dressing down by those who assume that I must have simply missed the point of poststructuralism and (...) postmodernism. Surely, the nay-sayers claim, no one believes in beginnings, middles, and ends anymore—certainly not since Godard taught us that we don’t need to put them in that order. Isn’t it just obvious (they continue) that we must reject the ideology of wholeness and unity, and opt instead for fragmentation, or self-reflexivity, or other violations of Aristotelian form? And there is no mistaking that, in some quarters, notions like mimesis and catharsis haven’t received much good press lately.But there are still kindred Aristotelians, and Bert O. States is one. His The Pleasure of the Play takes the Poetics as its pivotal text and sets in motion around it a lively discussion of plays from, yes, Oedipus Rex to The Real Inspector Hound, stopping along the way to consider Shakespeare, Chekhov, Brecht, Handke (among others), before concluding with an essay on Samuel Beckett’s Catastrophe, a play dedicated to Václav Havel. States adopts an open rather than a closed view of what the Poetics has to say about tragedy, expanding the discussion well beyond tragedy itself, out toward drama and, indeed, comedy. But he is clearly unwilling to go as far as another group of Aristotelians, notably Paul Ricoeur, Alasdair MacIntyre, and Jerome Bruner, who treat narrative as a mode of actual lived existence. States’s objective is to show the continued vitality of the Poetics, especially in terms of what it can tell us about drama in cultural contexts much removed from the one which offered Aristotle his range of primary textual material. [End Page 272]To be clear, then, States doesn’t claim to be doing either Poetics “scholarship” or exegesis. Indeed, this book is not what one might typically think of as a philosophical examination of the Poetics. Anyone looking for such a thing would do well to consult the excellent but unmistakably philosophical Essays on Aristotle’s Poetics, edited by Amélie Oksenberg Rorty. States is doing something else here. Like Aristotle, he is showing how dramatic structures work.The book is engaging. It features wonderfully turned phrases, examples that immediately illuminate a point, and nicely interwoven references to a range of theorists and philosophers who only rarely are found in each other’s company, for example: Richard Boyd, Martin Heidegger, Douglas Hofstadter, Wolfgang Iser, Maurice Merleau-Ponty, Francis Sparshott, Tzvetan Todorov. Some of States’s more delightful examples might offend Aristotle purists. Hard cheese to them. Consider how States uses Roland Barthes’s analysis of the newspaper feature story, or fait divers, to illuminate the structure of the great dramatic plots. In States’s examples—GENERAL SACRIFICES DAUGHTER IN WEDDING CEREMONY (Iphigenia at Aulis) or WIFE FORCED INTO ADULTERY BY HUSBAND, MOTHER, PRIEST (Mandragola) or, to use Aristotle’s own example, MAN’S STATUE AVENGES HIS MURDER (pp. 67-68)—what each mock headline captures is the peculiar, often ironic, internal logic of drama. For States, this peculiar logic is characterized by events which are simultaneously improbable, unthinkable, unanticipatable, yet—given the unfolding course of actions—uncannily probable after all.Central to understanding this internal logic is the Aristotelian notion of peripety, the critical “divulging event” (p. 49) which turns out to be just the reverse of what one intended (as for example Oedipus killing his father and marrying his mother). Where Aristotle seems to treat peripety as a mere plot device, States considers it “a principle of plot development.” Thus, the status of peripety as a crucial dramatic plot device is “really a symptom” of its more basic function (p. 86). This article explores female religious interaction in racially divided ‘colonial’ South Africa through the lives of five unmarried Anglican women missionaries who worked in and around Johannesburg between 1907 and 1960. It particularly analyses the quality of their personal relationships with African women converts, colleagues and students. Deaconess Julia Gilpin, in the imperial, anglicizing post-Boer War years, encouraged devout, respectable wifehood on the mine compounds, contributing to the corporate solidarity of praying mothers as a deeply entrenched feature of most black (...) churches. Dora Earthy interacted in a warmer, more egalitarian way with black churchwomen. Her transfer to Mozambique led not only to evangelistic building on African cultural traditions and pioneering anthropological research but also to the protection and validation of Christian widows’ autonomy against coerced remarriage. Frances Chilton and Dorothy Maud, despite sharply contrasting class origins, struggled to connect with more assertive networks of married women in the segregationist 1920s and 1930s, devoting their energies rather to guiding and enhancing African girlhood and youth. Hannah Stanton, in the more politically fraught 1950s, recognized the necessary independence of African actors and the limitations of outdated white liberal advocacy. Her training of African women promised new theological and organizational maturity, a potential collegiality, cut short by her detention in the 1960 State of Emergency and subsequent expulsion. The historical sweep of this survey suggests which personal and political conjunctures opened up or closed down meaningful interaction between colonized and colonizing women. It also offers a more positive evaluation of the intersection of race and religion as not invariably a ‘fatal combination’. The politics of the personal in women's joint educational, mission and social welfare ventures across the racial divide helped keep alive the idea of a single society and thus aided the surprisingly peaceful transition to democracy in South Africa in 1994.
